Who Can Serve Process in North Carolina
Governed by N.C. Gen. Stat. §1A-1, Rule 4.

Under N.C.G.S. §1A-1, Rule 4(h), service of process in North Carolina is traditionally made by the sheriff of the county where service is effected, a sheriff's deputy, or by any person who is not less than 21 years of age, is not a party, and is not related to or interested in the action. North Carolina's 21-year-old age requirement is the highest in the country — most states require only 18. Using a 19- or 20-year-old private server in NC invites a motion to quash. Served 123 LLC verifies age on every NC assignment.

North Carolina's service options under Rule 4(j)(1) include: (a) personal delivery, (b) leaving copies at the dwelling or usual place of abode with a person of suitable age and discretion residing there, (c) registered or certified mail, return receipt requested, or (d) delivery to an agent authorized by appointment or by law. Certified-mail service is a primary method in NC — not just a fallback. Service on entities is under Rule 4(j)(6). Long-arm jurisdiction uses N.C.G.S. §1-75.4. Service by publication under Rule 4(j1) requires a court order. Return of service is under Rule 4(d).

Key rule to know: North Carolina's 21-year-old age requirement for private process servers is unique — no other state requires this. A younger server's return can be quashed on motion regardless of how careful the service was. Every private server we assign in NC is 21+ with documented age verification. N.C.G.S. §1A-1, Rule 4(d), 4(h), 4(j), 4(j1), 4(j)(6); N.C.G.S. §1-75.4 (Long-Arm); §1F-1 (UIDDA)

What this means for your case

North Carolina's 100 counties are densely distributed — the state runs 500+ miles east-to-west from Nags Head to Murphy. Certified mail under Rule 4(j)(1)(c) is genuinely useful for routine service, but the green-card return must be signed by the addressee (not just anyone at the address). For evasive defendants, personal service with documented attempts is the reliable path. Served 123 LLC routes by region — Charlotte and Triangle metros get same-day capacity; mountain and coastal counties get in-region servers.

FAQ
North Carolina Service of Process — Common Questions
Answered under the North Carolina Rules of Civil Procedure. This is practical guidance, not legal advice.
Who can legally serve process in North Carolina?
Under N.C.G.S. §1A-1, Rule 4(h), service may be made by the sheriff, a deputy, or any person not less than 21 years of age who is not a party and not related to or interested in the action. The 21-year-old age requirement is unique to NC.
What North Carolina statute governs service of process?
N.C.G.S. §1A-1, Rule 4. Rule 4(j) covers methods, 4(j)(1) covers individual service including certified mail, 4(j)(6) covers entities, 4(j1) covers publication, and 4(d) covers the return.
Can I serve by certified mail in North Carolina?
Yes. Under Rule 4(j)(1)(c), service may be made by mailing a copy of the summons and complaint by registered or certified mail, return receipt requested, addressed to the party. This is a primary method, not a fallback.
Why is North Carolina's 21-year-old age requirement so unusual?
North Carolina is the only state requiring private process servers to be 21+ — every other state allows 18-year-olds. This comes from NC's Rule 4(h) specific language of "not less than 21 years of age." A 19- or 20-year-old server's affidavit can be quashed regardless of service quality. We verify age on every NC private-server assignment.
Do you serve in all 100 North Carolina counties?
Yes. Served 123 LLC covers every one of the 100 NC counties — from Charlotte and the Triangle through the Piedmont Triad, down the coast to the Outer Banks, and up to the Smoky Mountains. Hub counties (Mecklenburg, Wake, Durham, Guilford, Forsyth, Cumberland, Buncombe, New Hanover) offer same-day rush.
What must a North Carolina Return of Service include?
Under Rule 4(d), proof of service must state the date, time, place, and manner of service and identify the person served. Non-officer service is proven by affidavit. Certified-mail service is proven by the signed return receipt plus affidavit identifying the receiving party.
How fast can Served 123 LLC complete North Carolina service?
Same-day service when we receive the request before 11:00 AM local time in Mecklenburg (Charlotte), Wake (Raleigh), Guilford (Greensboro), Forsyth (Winston-Salem), Durham, Cumberland (Fayetteville), Buncombe (Asheville), and New Hanover (Wilmington). Next-day priority statewide.
Do you serve out-of-state subpoenas in North Carolina?
Yes. North Carolina has adopted the UIDDA at N.C.G.S. §1F-1. We handle clerk intake, NC subpoena issuance, and service statewide. See our North Carolina subpoena domestication page.
