Who Can Serve Process in Missouri
Governed by Missouri Supreme Court Rule 54.

Missouri is one of the strictest service regimes in the country on who may serve. Under Mo. R. Civ. P. 54.13(a), service may be made by the sheriff or by a person specially appointed by the court. Missouri does not allow general civilian service without per-case court appointment — a rule that catches out-of-state counsel regularly. Served 123 LLC files the Motion for Appointment of Special Process Server with each case as part of priority and rush intake.

Personal service is the default. Under Mo. R. Civ. P. 54.13(b)(1), substituted service may be effected by leaving a copy at the individual's dwelling house or usual place of abode with some person of the defendant's family above the age of 15 years who resides there. Note two Missouri specifics: (1) the 15-year-old age threshold is one of the lowest in the country, and (2) the recipient must be a family member who resides there — not merely any resident. Long-arm service under Rule 54.14 combined with RSMo §506.500. Mail service under Rule 54.15 is available on cooperative defendants.

Key rule to know: Missouri's Motion for Appointment of Special Process Server under Rule 54.13(a) must be filed and granted before service is attempted by any non-sheriff. Returns executed by a non-appointed civilian server are routinely quashed. We prepare and file the motion as part of every rush intake. Mo. R. Civ. P. 54.13, 54.14, 54.15, 54.16, 54.20; RSMo §506.500, §492.400

What this means for your case

The City of St. Louis is an independent city — not part of St. Louis County — with its own Circuit Court (22nd Judicial Circuit) and Sheriff's Department. A Clayton address is St. Louis County; a downtown Clark Avenue address is St. Louis City. Getting this right matters for filing, sheriff fees, and the return. We route correctly based on the actual street address.

FAQ
Missouri Service of Process — Common Questions
Answered under the Missouri Rules of Civil Procedure. This is practical guidance, not legal advice.
Who can legally serve process in Missouri?
Under Mo. R. Civ. P. 54.13(a), service is made by the sheriff or a person specially appointed by the court. Missouri does NOT allow general civilian service without court appointment — a Motion for Appointment of Special Process Server is required.
What Missouri rule governs service of process?
Missouri Supreme Court Rule 54. 54.13 covers in-state service, 54.14 covers out-of-state, 54.15 covers mail service, 54.16 covers publication, and 54.20 covers the return.
What is substituted service in Missouri?
Under Mo. R. Civ. P. 54.13(b)(1), substituted service may be effected by leaving a copy at the individual's dwelling house or usual place of abode with some person of the defendant's family above the age of 15 who resides there. Family relationship is required.
Do I need a Motion for Appointment of Special Process Server?
Yes — if you're not using the sheriff. Under Rule 54.13(a), any non-sheriff must be specially appointed by the court for the specific case. Returns executed by an unappointed server are routinely quashed. We prepare and file the motion as part of rush and priority service.
Do you serve in St. Louis City and St. Louis County?
Yes — these are separate jurisdictions. The City of St. Louis is an independent city with its own Circuit Court (22nd Judicial Circuit) and Sheriff. An address in Clayton is St. Louis County; an address downtown is St. Louis City. We route correctly based on the actual address.
Do you serve in all 115 Missouri jurisdictions?
Yes. Served 123 LLC covers all 114 Missouri counties plus the City of St. Louis — 115 jurisdictions. Hub jurisdictions (Jackson, St. Louis City, St. Louis County, St. Charles, Greene, Boone, Clay) offer same-day rush capacity.
What must a Missouri Return of Service include?
Under Mo. R. Civ. P. 54.20, proof of service must state the date, time, place, and manner of service and identify the person served. Non-officer service is proven by affidavit.
Do you serve out-of-state subpoenas in Missouri?
Yes. Missouri has adopted the UIDDA at RSMo §492.400. We handle clerk intake, Missouri subpoena issuance, and service statewide. Learn more on our subpoena domestication page.
